Please read these Terms & Conditions carefully. By downloading, registering, or using the A2B Logistics & Rentals website or mobile applications, you enter into a legally binding agreement with A2B Logistics & Rentals.
1. Acceptance of Terms
These Terms & Conditions ("Terms", "Agreement") govern your access to and use of the website (www.a2b.co.ke), mobile applications (Android and iOS), and transport services operated by A2B Logistics & Rentals ("A2B", "we", "us", "our").
If you do not agree to these Terms, you must immediately cease accessing or using our applications and web platform. Continued use constitutes explicit acceptance of these Terms and our Privacy Policy.
2. Scope of Services
A2B provides a multi-service mobility platform connecting users across three primary divisions:
- A2B Rides: On-demand ride-hailing and passenger transport matching riders with independent licensed drivers.
- A2B Deliveries: Express courier and package logistics for personal and business goods.
- A2B Vehicle Rentals: Peer-to-peer and fleet vehicle rentals connecting verified car hosts with qualified renters for short-term and long-term bookings.
3. User Eligibility & Account Requirements
To register an account or use A2B services, you must satisfy the following eligibility criteria:
- Age Requirement: You must be at least 18 years old to register a rider or delivery account, and at least 21 years old with a valid driving license to rent a vehicle or register as a host/driver.
- Account Accuracy: You agree to provide accurate, complete, and updated identity details, including your legal name, mobile phone number, email address, and official government-issued ID/License where required.
- Account Security: You are solely responsible for maintaining the confidentiality of your account password and authentication PINs. You assume full financial responsibility for all activities performed under your account credentials.
4. Bookings, Fares & Payment Terms
A. Fare Calculation & Rates
Fares for A2B Rides and Deliveries are estimated based on trip distance, duration, vehicle category, traffic conditions, and demand multipliers. For A2B Rentals, daily or hourly rates are established prior to booking confirmation.
B. Payment Methods
Payments are processed in Kenyan Shillings (KES) through secure mobile money gateways (M-Pesa) or authorized credit/debit card processors. You authorize A2B to charge your selected payment method for all fares, tolls, rental security deposits, cancellation fees, and applicable taxes.
C. Security Deposits for Vehicle Rentals
A refundable security deposit may be held during vehicle rental periods to cover potential fuel shortfalls, minor damages, or excess mileage charges.
5. Vehicle Rental & Host Obligations
Renters must inspect the vehicle prior to departure, report any pre-existing damages immediately via the app, return the vehicle with equivalent fuel levels, and operate the vehicle strictly within authorized territories.
A. Renter Duties
- Hold a valid Kenyan Driving License or recognized International Driving Permit.
- Ensure only verified drivers registered on the booking operate the vehicle.
- Adhere strictly to Kenyan traffic regulations, speed limits, and seatbelt laws.
- Return the vehicle at the agreed time, date, and location in clean condition.
B. Vehicle Host Duties
- Ensure listed vehicles are legally registered, roadworthy, clean, and mechanically sound.
- Maintain current comprehensive insurance coverage and up-to-date inspection certificates.
- Accurately describe vehicle specifications and rental availability on the platform.
6. Cancellations & Refund Policy
- Rider/Courier Cancellations: Free cancellation is allowed within 2 minutes of booking request. Cancellations made after a driver has traveled towards pickup may incur a standardized cancellation fee.
- Vehicle Rental Cancellations: Full refunds are provided for cancellations made at least 24 hours prior to rental start time. Late cancellations or no-shows may incur a fee equivalent to 1 day's rental charge.
- Host/Driver Cancellations: Frequent unexcused cancellations by hosts or driver partners may lead to penalty fees or account suspension.
7. Prohibited Activities
Users are strictly prohibited from engaging in any of the following activities on the A2B platform:
- Utilizing vehicles or delivery services for illegal contraband, weapons, hazardous substances, or unlawful goods.
- Operating vehicles while under the influence of alcohol, drugs, or impairing substances.
- Subleasing, renting out, or transferring a rented vehicle to unauthorized third parties.
- Off-road racing, dangerous stunt driving, or towing unauthorized heavy loads.
- Harassing, abusing, or discriminating against drivers, hosts, riders, or customer support staff.
8. Vehicle Damage, Insurance & Liability Disclaimers
A2B operates as a technology and mobility facilitator. While we enforce strict verification standards, the following liability terms apply:
- Insurance Bounds: Rented vehicles and rides are covered by third-party or comprehensive insurance policies as mandated by Kenyan law. Deductibles and non-covered damage resulting from reckless driving or breach of contract remain the direct financial liability of the renter or driver.
- Personal Belongings: A2B is not liable for lost, stolen, or damaged personal property left inside vehicles during rides, deliveries, or rentals.
- Limitation of Liability: To the maximum extent permitted by law, A2B shall not be liable for indirect, incidental, consequential, or punitive damages arising from app usage or vehicle operations.
9. Intellectual Property Rights
All brand logos, code, domain names, UI designs, icons, graphics, and trade dress associated with A2B Logistics & Rentals are the exclusive intellectual property of A2B. Unauthorized copying, reverse engineering, or reproduction is strictly prohibited.
10. Account Termination & Suspension
We reserve the right to immediately suspend, block, or permanently terminate any user, driver, or host account without prior notice if:
- You breach any provision of these Terms or our Privacy Policy.
- You engage in fraudulent booking behavior, payment defaults, or chargeback abuse.
- Your driver's license or vehicle insurance expires or is revoked by authorities.
- Safety complaints or severe rating drops indicate a risk to community standards.
11. Governing Law & Contact Information
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any legal dispute or claim arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts located in Nairobi, Kenya.
